TERMS AND CONDITIONS

These Terms and Conditions govern access to project4pros.com and purchases made through Project4Pros. By creating an account, using the website or purchasing a project opportunity, you agree to these Terms.
If you do not agree, do not use the website.
- Marketplace Service
Project4Pros operates a marketplace through which contractors may purchase access to information concerning prospective home-improvement projects.
Project4Pros is not the homeowner, contractor, construction manager, employer, lender or party to any contract ultimately formed between a homeowner and contractor.
- Contractor Eligibility
You must be at least 18 years old and legally capable of entering contracts. Contractors are responsible for maintaining all licences, registrations, insurance and permits required for the services and locations in which they operate.
You must provide accurate account information and keep your login credentials secure.
- Nature of a Lead
A purchased lead provides access to the information available to Project4Pros concerning a prospective project. Unless expressly stated otherwise, Project4Pros does not guarantee:
• That the homeowner will answer or return communications
• That an appointment will occur
• That the project will proceed
• That the scope, budget or timeline will remain unchanged
• That the contractor will be hired
• Any minimum revenue, profit or conversion rate
Contractors are responsible for conducting their own verification, estimates, inspections and customer qualification.
- Exclusive Leads
A lead marked “Exclusive” is intended to be sold through Project4Pros to one contractor only. Exclusivity does not guarantee that the homeowner has not independently contacted other contractors or received other estimates.
When successfully purchased, stock for the lead is reduced so it cannot ordinarily be purchased again through Project4Pros.
- Permitted Use of Lead Information
Purchased information may be used only to contact the homeowner regarding the specific project described in the listing.
You must not:
• Resell, transfer or publish lead information
• Add homeowners to unrelated marketing lists without lawful consent
• Use automated calls or messages without the legally required consent
• Harass or repeatedly contact a homeowner who asks you to stop
• Misrepresent your identity or relationship with Project4Pros
• Use purchased information for unlawful, discriminatory or fraudulent purposes
Contractors are independently responsible for compliance with applicable privacy, telemarketing, licensing, consumer-protection and do-not-call requirements.
- Prices and Payments
Prices are displayed in U.S. dollars unless stated otherwise. Payment is due at checkout and is processed by Stripe or another displayed payment provider.
You are responsible for any applicable taxes, currency-conversion costs or payment-provider charges. Project4Pros may correct pricing errors or cancel fraudulent, duplicated or unauthorized transactions.
- Refunds
Purchases of unlocked lead information are generally final because access is delivered immediately. Limited refund or credit eligibility is governed by the Project4Pros Refund Policy, which forms part of these Terms.
- Accounts and Security
You are responsible for all activity performed through your account. Notify hello@project4pros.com immediately if you suspect unauthorized access.
Project4Pros may suspend or terminate accounts associated with misuse of homeowner information, chargeback abuse, fraud, unlawful communications or violations of these Terms.
- Website Availability
We attempt to keep the website and purchased information available, but uninterrupted or error-free operation is not guaranteed. Maintenance, hosting failures, security events or circumstances outside our control may temporarily affect availability.
- Intellectual Property
The Project4Pros name, branding, website design, software, text and marketplace materials belong to Project4Pros or its licensors. No ownership rights are transferred to users.
- Disclaimer
The marketplace and its information are provided on an “as available” basis to the fullest extent permitted by law. Project4Pros disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement where legally permitted.
Nothing in these Terms excludes a right or warranty that cannot lawfully be excluded.
- Limitation of Liability
To the fullest extent permitted by law, Project4Pros will not be responsible for indirect, incidental, special, punitive or consequential damages, lost profits, lost opportunities, contractor expenses or disputes between a contractor and homeowner.
Project4Pros’s aggregate liability relating to a purchased lead will not exceed the amount paid for that lead, except where applicable law does not permit that limitation.
- Indemnification
You agree to defend and indemnify Project4Pros against claims, losses and reasonable expenses arising from your services, communications with homeowners, handling of personal information, legal or licensing violations, or breach of these Terms.
- Governing Law
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Nothing in this section prevents a consumer from relying on mandatory rights that apply in their jurisdiction.
- Changes
We may update these Terms from time to time. Continued use after updated Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by law.
